Trust, Flexibility, and Long-Term Cost.
With an Upfront plan, your paying for your site upfront, placing a lot of trust in my service, meaning that you lose the flexibility to dip your toes in. However you will save money long term, assuming you stick with my services.
With a Monthly plan, you’ll be paying for the site as part of a monthly service, much like a Netflix Subscription. This means you’ll be placing less trust in my services but will keep flexiblity to jump ship if your dissatisfied early on with no harm done to your business. However, in the long you will lose money assuming you stick with my services.
No, there are never any extra or hidden fees apart from your flat monthly rate (and your upfront payment if you choose). Despite what you may think, a website is never a one-time product, it is in fact a constant entity that needs continuous support, management, and services which costs time and money. That’s why I act on a monthly-fee model, it’s simply more accurate.
The UNLIMITED ↻ plan includes two extra things for an increased monthly fee:
Firstly, you get Unlimited and Unrestricted Changes. This means that if, at any point, you wish to change anything about your site, for example you want to add an extra page to correspond with a new hair-dye service you’re offering your customers, you simply get in touch with me.
Secondly, you get Professional Business Email. This is a package that includes as many email addresses as you like for your business, and because of my expertise, these email addresses actually work and your emails actually get delivered, unlike other agencies and freelancers with no expertise in this field.
To cancel, simply get in touch with me with 14-days notice before your next billing date, and your service will be cancelled at no extra charge.
I will do my best to migrate your site for you, and in most cases this will be a seamless process. However, I can only garuantee a raw backup of your site will be given to you [I use Updraft Plus for this] after it has been disconnected and/or from my services [these may include Microsoft Exchange Server, Elementor Page Builder, Cloudflare, Hosting].
As for the domain name, I will garuantee a full transfer of ownership and guide you through this process.
It depends on several factors:
Firstly, and most importantly, the size of the site determines how much work will be needed to create it, and how much work is needed to maintain it.
Secondly, the features of the site, for example a site with many complex features will require more start-up and management time than a site without.
Finally, there is the Unlimited ↻ plan which includes unrestricted changes and professional email, which increases the cost.
This is very similar to the considerations for the cost of the site. The bigger the site, the more complex features on the site, if there’s email included, will all increase the time needed.
Also, if you keep getting the site revised before it goes live, and if you are slow to provide me with information needed for your site such as images and text, it will obviously take longer. Hence, you, the client, have quite a direct affect on this amount of time.
Terms
Section 1: Services Provided
1.1 Glistex Web & Email agrees to provide the Client with the Plan specified via email or writing and agreed upon via any communications means.1.2 The Client understands that the Services provided by Glistex Web & Email are subject to the terms and conditions outlined in this Contract and any additional documents referred to herein.
Section 2: Payment Terms
2.1 The Client has the option to choose between two payment methods: paying upfront or paying a small continuous monthly fee. 2.2 For upfront payment: 2.2.1 The Client agrees to pay half of the total project fee as a non-refundable deposit before the project begins. This deposit will secure the booking and initiate the project. 2.2.2 The remaining balance will become a non-refundable deposit upon completion of the first draft and will be due upon the completion and approval of the project. 2.3 For the continuous monthly fee: 2.3.1 The Client agrees to pay a monthly fee as specified in the chosen service agreement made via email or writing. 2.3.2 This monthly fee will cover all services outlined in the monthly plan, except the ownership of the site as a product. 2.4 All payments shall be made via Direct Debit unless otherwise agreed upon in writing by both parties. 2.5 The Client acknowledges that failure to make timely payments may result in the suspension or termination of the Services provided by Glistex Web & Email. 2.6 Glistex Web & Email currently operates as a non-VAT registered business. However, in the event that Glistex Web & Email becomes VAT registered, VAT may be charged on payments for applicable goods and services. 2.7 If Glistex Web & Email becomes VAT registered, any VAT charges will be applied in accordance with the applicable UK VAT laws and regulations. 2.8 Glistex Web & Email will provide the Client with reasonable notice of any changes related to VAT registration and charges. Such notice will be communicated via email or other suitable means. 2.9 Glistex Web & Email will make reasonable efforts to avoid fee increases whenever possible. However, Glistex Web & Email reserves the right to change prices during the agreement, including the ability to increase pricing in alignment with UK inflation. 2.10 In the event of a price change, Glistex Web & Email will provide the Client with at least 14 days’ notice before the next billing date implementing any adjustments to the pricing. Such notice will be communicated via email or other suitable means.
Section 3: Duration of Contract
3.1 This Contract will automatically renew on a rolling monthly basis unless terminated by either party in accordance with the termination clause outlined in this Contract.
Section 4: Termination
4.1 If the Client fails to pay, Glistex Web & Email may terminate the Contract with 30-days’ notice, written or via email. 4.2 In addition to termination due to payment failure, Glistex Web & Email reserves the right to cancel the monthly contract with the Client and stop providing services for any reason with 14-days notice. Typically, Glistex Web & Email will ensure migration, but is not obligated to do so other than providing a raw backup of the site.
Section 5: Website Suspension
5.1 Glistex Web & Email may suspend the website for reasons including, but not limited to, late payment, refusal of payment, cancelled Direct Debit mandate, inappropriate/illegal content, or management discretion. 5.2 Glistex Web & Email is not obligated to notify the Client of the website suspension, which can occur at any time at the management’s discretion, unless in the case of late payment, in which case Glistex Web & Email will give the Client 30-days’ notice in writing or email. This is independent of the billing date and the actual date the website goes offline due to hosting/domain payment terms/considerations.
Section 7: Limitation of Liability
7.1 Glistex Web & Email will make reasonable efforts to ensure the accuracy and functionality of the Services but does not guarantee any specific results or outcomes. 7.2 Glistex Web & Email shall not be liable for any damages, including but not limited to direct, indirect, incidental, consequential, or special damages, arising out of or relating to the use or inability to use the Services.
Section 8: Governing Law
8.1 This Contract shall be governed by and construed in accordance with the laws of England and Wales.
Section 9: Background Check
9.1 Glistex Web & Email reserves the right to conduct a background check on the Client and their business (if applicable) using third-party providers. 9.2 The Client will be informed of the background check before processing via email, and the Contract will not proceed until permission has been given by the Client. 9.3 Management reserves the right to ask further questions, request identification, or refuse services based on the results of the background check. 9.4 Glistex Web & Email can refuse pay monthly services if the business is deemed too risky or falls under restricted categories, such as Over 18 websites like Gambling or competition-based websites, at management’s discretion.
Section 10: Eligibility
10.1 Clients are responsible for ensuring they are eligible for Glistex Web & Email services based on the following requirements: 10.1.1 Not being on the insolvency register. 10.1.2 No company disqualification. 10.1.3 Having the funds to cover the full monthly contract agreement. 10.1.4 No previous ban or unpaid bills with Glistex Web & Email. 10.3 Glistex Web & Email does not provide services to clients or businesses who have previously been banned from using our services, have outstanding unpaid bills with us, or have failed to complete their contract payments in full. 10.5 Clients must not be engaged in providing illegal services or products. 10.6 We do not provide services to clients involved in any kind of fraudulent activity. 10.7 Glistex Web & Email reserves the right to request documentation or information to verify the client’s eligibility for our services, and decisions regarding eligibility will be made at our sole discretion.
Section 11: Late Payment
11.1 Late monthly payments will be subject to UK law for late payments and suspension if the overdue balance exceeds 30 days. 11.2 Failed payments over 30 days will incur a £15 fee to reactivate the account. If the Client informs Glistex Web & Email of the impending payment failure before the due date on the first occasion, Glistex Web & Email may come to an internal arrangement.
Section 12: Suspension and Termination
12.1 The Client will be placed into a 1-month rolling contract, with a 14-day notice period to cancel. 12.3 Glistex Web & Email reserves the right to suspend the website for reasons including late payment, refusal of payment, cancelled Direct Debit mandate, inappropriate/illegal content on the website, or any reason management deems necessary. Glistex Web & Email may suspend the website without prior notice at management’s discretion, unless in the case of late payment, for which there will be 30 days’ notice. 12.4 Glistex Web & Email has the right to terminate the contract if the Client is engaged in fraudulent activity, and no loss will be held responsible for Glistex Web & Email during the investigation. 12.5 After 1 year of an overdue invoice, all services can be permanently removed or disabled with no recovery, including but not limited to the domain name, hosting, SSL, website licenses, email addresses, and domain name, which will be placed back on the market for others to purchase.
Section 13: Cancellation and Refund Policy
13.1 The Client may cancel the Direct Debit Mandate, but any remaining contract length may still be applicable and considered a breach of contract. 13.2 Glistex Web & Email may cancel the Direct Debit Mandate if the Client is in breach of any terms of the Contract. 13.3 In the event of cancellation, the Client is fully responsible for complying with UK law and ensuring any digital goods and the associated costs are appropriately managed. 13.4 In the event of a cancellation, Glistex Web & Email will typically ensure migration, but is not obligated to do so other than providing a raw backup of the site.
Section 14: Third-Party Services
14.1 Glistex Web & Email may use third-party services, including but not limited to IONOS, Cloudflare, Namecheap, WordPress, Google, including Analytic services, and various related WordPress services and plugins. 14.2 The Client is subject to the terms and conditions of these third-party services automatically upon using them.
Section 15: Website Hosting
15.2 Glistex Web & Email holds the right to suspend the website immediately without warning if it affects the performance of other websites on the same server. 15.6 Glistex Web & Email servers are provided by third-party companies, and their terms and conditions will automatically be applied to the Client. 15.7 The client can request to cancel their contract and transfer their site, providing 14 days notice before the next billing date. Glistex Web & Email will not take responsibility for setting up the files on a new host once they leave Glistex Web & Email. 15.8 Glistex Web & Email will make reasonable efforts to ensure server uptime for the Client’s website. Glistex Web & Email is not obligated to ensure that the Client’s website is live 100% of the time, but we will make reasonable efforts to ensure the server remains online.
Section 16: Miscellaneous
16.1 This Contract constitutes the entire agreement between the parties and supersedes all prior agreements or understandings, whether written or oral, relating to the subject matter hereof. 16.2 Any modifications or amendments to this Contract must be in writing and signed by both parties to
